Legal Question in Family Law in Texas

My ex-husband is court ordered to pay half of all medical/ dental expenses within 15 days of me sending a copy of the bill/ receipt. He waits months and months, letting the amounts pile up. He then will pay only a fraction of what's due. Can I charge late fees? Most of the time i have to put these on credit cards and end up paying interest until he pays his half.

Ok. You might want to talk to an attorney in your county if these fees have grown huge & try to hold him in contempt on medical fees.

If you give him the bills promptly and he does not reimburse you within 15 days, then that is the problem.

Quite frankly, I've not had this problem asked of me before. I don't know what the judge in YOUR county would do.

Have you thought of paying 50% and just asking him to pay the medical provider the over 50% direct. Then he would be liable for the late fees to the medical provider for any money due?

So if the bill is $100 then you pay $50 and you ask the medical provider to bill him $50 and if he does not pay then he owes the medical provider $50 and then you don't incur $50. Then you don't incur fees and late fees? Since he's shown a disregard of judge's order -- it's an idea on future bills!

In the meantime, you might want to hire an attorney, since the local judge might not find his "memory" problem very funny, since he is in violation of the judge's orders and you have incurred fees. Plus, you can ask for your attorney fees! That might sober him up quite a bit!
