House during a divorce

My housepayment is 2 months behind. I have a TRO against my husband so he is not living at the house. I cannot afford to make the payments so I will be moving out in two weeks. We will be foreclosing the house. I am filing for divorce ASAP. How do I list the house in the divorce or do I even need to?

Yes you need to list the house in the divorce. You may still be a title owner at the time, and you may very well owe a deficiency -- and you need to determine who will own the debt.
