Legal Question in Family Law in Texas

If my husband owned the home before we were married but the mortgage payments have been made through our joint account, which we both contribute to since getting married, and we have done remodeling and decorating together since getting married, will the house still be considered his separate property or community property? If we were to refinance the house with both names would that make it community property?

The character of the house � separate or community - is based on inception of title. Unless your husband does something drastic, such as deeding over to you an interest in the house, it will always be his separate property.

If you refinance the house in both your names, it does not become community property.
