Legal Question in Family Law in Texas

If I'm the legal mother and I want to move to another state with my kids can I get introuble if I don't have their father consent?

You can move but if the father files for divorce and serves you then the TX court can make the children move back to Texas.

I would urge you to talk to a Texas attorney before you spend the money and move away from Texas. Normally TX judges like Texas children to remain in Texas.

I would also urge you to consider mediation rather than litigation. At mediation you have a better chance to leave Texas than you do before a judge. Mediation often gives you more flexibility than litigation. Of course it will depend on your spouse.
