Legal Question in Family Law in Texas

I got married just over a month ago; however, our officiant didn't sign the license and it wasn't filed. I'm now thinking of leaving my spouse. Would I need to file divorce?

You probably now have a common law marriage so you would need a divorce. Talk to a famiily law attorney in your county about your options.

Usually there is a suit to prove the common law marriage followed by a divorce.

You will more-than-likely need to file for divorce, as you are, if nothing else, common law married, in the state of Texas which recognizes common-law marriages.
