Legal Question in Family Law in Texas

I am moving from Texas to Colorado . My child's dad has a court order keeping my son in Texas . He said its okay for me to move if he gets my son summers and every Christmas . Said he will draw up the papers for us to sign and notorize. Is this legal? Will it over rule the court order?

What needs to be done is an agreed modification, which will result in a new court order. What you and he want to accomplish is very easy if both of you are in agreement, but it will not be enforceable by either of you if it is not done through the court. There is no long waiting period, and the process could be completed in a couple of weeks or less. You will need an attorney to look over the new order for you. You do not want to simply rely on a document prepared by him or his attorney. Contact me if you want to discuss the matter further.
