Before my parental rights are terminated and my child is in foster care can I sign over temporary custodial rights to my sister OR does she have to adopt?

If there is a termination lawsuit pending against you, you cannot sign over much in the way of rights. What you could probably do is enter into a Non-Parent Relative Authorization Agreement. The State of Texas provides a form you can use. Follow the instructions very carefully.
