If a person was common law married to a person and then turns around and gets married does that void out the actual marriage?

Texas does not allow multiple marriages. If you are in a valid marriage you cannot enter into a second valid marriage.

First thig to do is determine if there is actually a common law marriage. Was a declaration of informal marriage filed? If not, has the marriage been confirmed in court? Your question, unfortunately, does not have a single, straight forward answer. Your best bet would be to see your local legal aid provide, if you have one, go to your county law library and ask your question, or see an attorney. An attorney will be able to ask all the necessary questions and apply the answers to Texas law and provide an answer for your individual situation.
