Legal Question in Family Law in Texas

property

If one spouse owned the house prior to the marriage and the other spouse has put money into the house, yard(landscaping, trees, ect), repairs, overall improvement to household. Also property value has went up in the area where we live. How is everything dispersed? Is there an original value to home then and now it's worth more, the difference is given to other spouse? I've been told it's 50/50 and I've been told I can't do anything but move. I don't have the money to find out if I have any rights to the home, improvement, ect. The home was built, financed, paid for by one spouse. We have been together for 6 years,

married for 3 years. Also other vehicles, recreational vehicles, ect, have been bought. What happens with these? Also, he has bank accounts with his name only. Says what's his is his and mine is mine. Am I entitled to any of the money in accounts? There are no children from this marriage, but a child is here from previous marriage. I am not the one who wants the divorce, I'm not here to steal someone blind, I just want to know what I can do from losing what I have put into this marriage. So me and my child will have something and somewhere to live. His better paying job is because of me? Can you please let me know?

Your property issues are complex and you need to consult with an attorney.

You need to find the money to hire an attorney.

Please do not sign anything or agree to anything without having spent time in an attorney's office reviewing your situation and obtaining advice specific to your situation.

All of what I say I is "general", since your specific circumstances could change the outcome. The house is part of his separate estate. The community estate made improvements to it, and is entitled to be reimbursed for those improvements. You are entitled to one-half of those improvements.

Property acquired during the marriage (except by inheritance and gift) is community property. It doesn't matter whose 'name' it is in -- it is owned by the community estate. This includes vehicles, bank accounts, 401K, retirement etc.

Based upon your information, you are not entitled to longer-term spousal support, but probably are entitled to temporary spousal support during the pendency of the divorce.

Please do not proceed without the guidance of an attorney. And please be discreet about meeting with an attorney. It could affect whether things 'disappear'.
