Legal Question in Family Law in Texas

reason for divorce

I have been married for 1 year and began talking to another man without my husband knowing. I never met him nor had sexual realtions with the other man. Is talking and talking only grounds for divorce?

Re: reason for divorce

Texas has limited grounds for divorce.

The Texas family code is available on-line.

Of course, Texas also has NO FAULT divorces. If someone no longer wants to be married, the divorce will eventually be granted. You cannot force someone to stay married in Texas.

The claim of adultery is common. It must be proved. Talking is NOT adultery. However, claiming a fault ground for the divorce only relates to the property division. For example, instead of a 50/50 split the person alleging adultery would like a 60/40 split.

I strongly urge you to talk to an attorney.

Knowledge is power.
