Legal Question in Family Law in Texas

seperation/divorce/marriage

My fiancee was in a relationship for about 8 years off and on.. about 2 years ago they called it quits for good. We have been together ever since. They have an 8 year old daughter, they were never married, and she never used his last name, they dont have any property together... I need to know if it would be illegal to get married to him, or does he have to get a divorce? what needs to be done?

IF they were commonlaw married, and no one has taken action to formally end the marriage after two years of separation, then the relationship has ended and you can marry him.

If they were NOT commonlaw married, then you can marry him anytime.

None of this changes his obligation to support his child.
