Legal Question in Family Law in Texas

I am in a situation that I dont know which way to turn with a lawyer or CPS .I live in Texas and am concerned for my 2 year old grandaughter. My daughter was living with me and my fiance but she seemed to be gone more than home and then on certain days my grandchild was taken to the person whom my daughter said was the dad but there is no one listed on her birth certificate but she does hav his last name. Anyway he took her out of the daycare when I told him until a court tells me that he can see her and we do this legally he cant well of course my daughter told him it was ok so he came up there and took her out of her room carrying her like a football and she screaming and yelling. I took care of her sun- thurs .My concern is her safety there cuz I hear there is drug use and its unclean should I involve CPS first before a lawyer

I only mediate CPS cases so I'm no expert on CPS and how they operate in your county.

I don't know if CPS wil even get involved. Also, once they get involved, CPS can look into your home situation too. I'm sure that Dad will make allegations against mom, you and even your fiance. CPS might not return the child to your custody. The child could end up in foster care. Once the CPS door is open you cannot close it. Once a CPS file is opened, it is never truly closed - it can haunt you for the rest of your life.
