Legal Question in Family Law in Texas

My son was arrested for assalt/family violance supposedly based on the officer responding assumption that he had hit his wife. Is this presumption of assult legal even if the wife did not accuse him?

The officer's "assumption" doesn't matter. It's the COURTS that matter. On trial day, your son and his wife should go to Court, and the wife should testify that he didn't hit her.
