wife takes child from alcoholic husband

i picked my son up from my mother in laws house in wichita falls texas after my husband went on a drunken bender and brought him to my mother's house in pampa texas and now he is saying that his son was kidnapped. is there is validity to this. our legal state of residence is new mexico

You may want to check with attorneys in New Mexico, but am not sure why NM is relevant in this issue.

Are you married, divorced, separated? Are there any outstanding court orders? If not, as the child's mother, you have the right to pick up the child. If there are outstanding court orders, and you are in violation of that order, get a lawyer to schedule an emergency hearing to establish your position. I have seen PD prepare reports on interference with child custody, but wait until the family court rules, before making a decision on charges.
