Legal Question in Medical Leave in Texas

Partial denial for family leave

After receiving approval from the HR dept. of my company for family medical leave for care for my terminally ill mother, my

scheduling manager notified me that only 1 day of the 3 days requested for leave would be approved because my brother, who also works for the same company has been approved for leave on days that would overlap. They are only approving the day that doesn't overlap claiming that he can care for her and there would be no reason for me to be there on the overlapping days, without additional medical information from the doctor stating we both would be needed. My mother lives in Minnesota and we live in Texas. My question is: If 2 employees working for the same company request family leave, can they restrict the family leave based on overlapping requests by approved family members?

The short answer is yes, the company can do as it did. When leave is requested by members of the same family, the company can limit the leave to 1 leave time.
