Can I fill a lawsuit for this?

I moved out from a property about 5 1/2 ago and the manager of the property offer me to stay another week for free so he can try to get me a smaller apartment that I was looking for. I moved out on Dec 06,2007 because they could find the apartment for me. They are supposed to sent me a $150 check within 30 days from that date. However, they sent me $38 charging me that free week and they sent the check after 5 month. I have been calling them for a long time but they are ignoring me. My question is : Is it worthy to fill a lawsuit for that? Thank you for your help

Did you have a written lease originally? If so, it may depend greatly on the contents of that original lease.

You need to consult with an attorney to decide one way or another whether to file a lawsuit. The attorney will be able to evaluate your written lease (if one exists) and determine whether the facts you have described would make it worth pursuing the matter in court.

You can file a lawsuit, but I seriously doubt that it would be worth the time, effort, cost, and aggravation of filing a lawsuit for $38.00 plus nominal statutory damages.
