Legal Question in Civil Litigation in Texas

Home remodel contractor action

I paid a company 50% of the cost to do some remodel work the kitchen of my home. It’s been over a month and they have not started the job. I have a contract with them. I call the company but reach there voice mail, but it is full and I can’t leave a message. I faxed them a letter ask them to contact me, but still no reply. What could I do next, and what legal action can I take?

Hopefully you have a street address to make a personal visit to their office, and find out where they are headed with your money. Of course you always can bring a lawsuit, but unfortunately, too many people get nothing other than an assumed name or name of a non-existent company. Without the name of some real people or real people in charge of a real company, you are not likely to achieve anything better that suing an emply sack. Law enforcement people will not be inclined to go find them for you.

Mr. White has spelled out the situation. But to cover yourself, send them a letter by certified mail, demanding the return of your money, stating that they have not made any attempt at performance, and that their contract is terminated. That should keep them from making further demands and short-circuit any attempt on their part to place a lien on your property.
