Legal Question in Civil Litigation in Texas

If a tree in the next door neighbors yard is hanging in our yard and we are not able to trim it and a limb should break and fall on our property and do damage who is liable, us or the neighbor where the tree is located?

Why wouldn't you be allowed to trim it?
