Legal Question in Immigration Law in Texas

pregnant by an illegal alien

What kind of rights do I have against him? He, now, decides he doesn't want to be here for the baby in any way. All I care is that he signs the birth certificate but he is unwilling to do even that now. What can I do? He has not paid for anything or supported me at all blaming me for everything. I did not want it to cone to this but he leaves me no choise now. If there is anything other than calling INS on him I would really like to do that. But if thiers not then I plan on calling INS because I would hate to see him do that to another woman.

You file and serve him with a Suit Affecting Parent-Child Relationship, with a request to establish his paternity.

You can also contact USCIS -- but having him removed from the US makes your lawsuit nearly impossible to enforce.

Legally you can do both, but practically speaking, doing one will negate the other.

You need to retain an attorney in your area first to protect the rights of your child to support. Once that has been established, then you can proceed down other avenues.
