Legal Question in Insurance Law in Texas

Insurance Company Responsibility

Several months ago I was involved in an accident. The insurance cos are in a dispute as to assessing fault. My vehicle is financed and I have full coverage insurance. While the vehicle is drivable, it has sustained considerable body damage. Since I have full coverage should not the damage be repaired and determination of responsibility be resolved later? As it is financed, technically the bank owns the vehicle, and its value is diminished due to the insurance companies disagreement. Since I am paying for full coverage should they not be required to repair the damage?

Re: Insurance Company Responsibility

You can make a claim to your insurance company for repairs under the policy. You will have to pay the deductible, but that can be reimbursed to you after the insurance companies resolve their nit picking. If your insurance company will not resolve your claim withing a reasonable time, you may sue them. Good Luck.

Re: Insurance Company Responsibility

yOUR INSURANCE COMPANY SHOULD ACT WITHIN 15 DAYS...BUT YOU HAVE TO PAY DEDUCTIBLE..and you own the car, not the bank, and the loss of use because your insurer did not act should be paid by your insurer..
