Employment evaluation

My husband recently was passed for any yearly pay increase despite receiving a good employee evaluation in May. When he spoke with his supervisor, he was told another evaluation was done between manager and supervisor (which my husband was not aware of) and he received some low marks. Also, no one else in his department received a pay increase except for one person. Said person is a supposed personal friend or informant to the supervisor. My question is: Is it legal to carry out a covert second employee evaluation without notifying the employee of the outcome? My second question is: If one person in a department receives a pay increase and the others receive nothing, can it be considered as discrimination? The employees who did not receive a pay increase received good marks on their employee evaluations. I appreciate any insight you can give on the situation. Thank you.

Unless you have a contract or a union to protect employees...a company may treat you as it wishes..nothing illegal about it
