Legal Question in Employment Law in Texas

refund of professional employment fees

my husband signed a contract with an upscale professional employment company and paid over $7000 for them to teach him how to gain potential high income employment. Before a year was over we have since found out that he has cancer and has a life expectancy of 3-5 years. we contacted the company requesting a portion of the fee returned to us for medical expenses and simply for the fact no one is going to hire him now with his medical condition. they sent a letter stating how ''sorry'' they were for his condition and offering only 1/4 reimursement to him. ( this is for a 3 year contract mind you). my (our) question is would it be in our interest to try to sue them for more of the refund?

we are in bad need of the money to even start payment on the medical bills we have already accumulated and this money would come in very handy especially since he has not been able to work while the chemo and radiation is taking place.

thanks

Re: refund of professional employment fees

Unfortunately, unless the contract your husband signed (or other related literature supplied to him) provides for a refund in these circumstances, it is unlikely that he has any entitlement to a refund. You might want to have that agreement and surrounding circumstances reviewed by a lawyer, but there is no legal basis I can think of outside of the agreement which would entitle him to any refund.
