I don't know if this got posted to Texas attorneys, but as a California attorney I received it, but cannot give you any advice as I am not licensed in the State of Texas. If you did not post it to Texas attorneys, please re-post it so you can get proper advice.

You should post your message for an attorney in Texas. In general, California attorneys aren't required to know the ins-and-outs of another state's statutes and procedure. Good luck!
