Legal Question in Legal Ethics in Texas

Is this legal

My son was arrested in San Antonio where he lives with his Dad. At that time I lived in Plainview, Tx.. He was made to appear in Plainview for questioning on possible charges of theft of a firearm. I retained an attorney for him in Plainview. the attorney just questioned my son and was not even able to appear with us at his hearing but advised us on what to do. He charged me a $1,000.00 retainer fee. No charges were ever brought against my son, but the lawyer will not refund me any of my money. Is there not anything I can do to recoup some of my money? I have requested some kind of billing from his office and have yet to hear. All this happened back in March of this year.
