Legal Question in Medical Malpractice in Texas

The non diabetec - diabetec

In my pregnancy parkland hospital diagnosed me with diabetes, had me admitted to the hospital and started on insulin. I missed to weeks of work from being able to function from the insulin. I also had to go through the trauma of learning how to give myself injections. I had learned after a trip to the er and my next appointment that i do not have diabetes. Do i have any type of case?

While you may have a claim for "mis-diagnosis," the value of your claim is based upon your "damages," and your damages in this case are relatively small. Since it costs a great deal to prosecute a medical malpractice claim (you have to hire medical experts to testify and this can cost you literally tens of thousands of dollars), it is very doubtful, in my opinion, that you could recover enough from an ultra-conservative Dallas County jury to justify the high cost of litigation. Additionally, your jurors would be Dallas County taxpayers, who would be unlikely to impose a large judgment against Parkland, a taxpayer-funded institution.
