Legal Question in Personal Injury in Texas

Not at fault accident...So why do I have to pay?

My husband and I were involved in an auto accident. The other driver was at fault and was given a ticket. My husband and I were both injured.The Dr said I may be off work for awhile and may need knee surgery. I could do light duty but my job does not permit that.

The insurance company has just told me that my car is a total loss. My insurance company only wants to pay about 8000 for the car.I still owe $11,678 on it.The other company has not looked at the car yet.We are trying to handle the situation on our own. My questions are as follows:

1. Since my husband is self employed and is paid cash (does yard work)can he ask for lost wages how does he prove his claim?

2. I was starting a new job this month making considerably more than I am making now, but I cant start due to my injuries. We were also going to relocate and paid a deposit on an apartment and rent is due this month.Since we are both out of work with no pay we will lose our apartment and our deposit. Can we be compensated for any of these losses?

3.How do we handle having our car paid off or replaced?

I was in the same situation a few years ago and came out with no car, a car note and no money to buy a car.

I recommend contacting an attorney to assist you with your claim. You've suffered a loss of your vehicle, your health, and lost wages. The other driver's insurance adjuster is not your friend and is not there to help you or make you whole. They will settle the claim for the least amount of money that they possibly can. I would think that your past experience would be sufficient for you to take your case to an attorney rather than run the risk of suffering the same fate over again.
