Legal Question in Personal Injury in Texas

Fell at work

Fractured left elbow when I fell off loading dock. Dock plate broken, fell when truck pulled away suddenly. Full cast for 6 weeks. Was unable to exercise or function one handed. Still received pay and back at work. Do I have a case? Thanks

In Texas, if your employer carries workers' compensation insurance, you cannot make a claim against your employer for your injury; you can only collect benefits from the workers' comp insurance carrier. However, if the truck that "pulled away suddenly" was owned or driven by someone employed by a different company from the one you work for, you could make a claim against that company if they were negligent in causing your accident.
