Legal Question in Personal Injury in Texas

Got hit by a car

I got hit by a truck walking out of Walmart. I was in the hospital from Tues.-Sat. with a fractured plevis and ankle. I found out today I have to have surgery on my ankle. I am getting around on a walker. My job requires me to be on my feet atleast 8 hours. The police report says no one was at fault. I thought the ped. always had the right of way. What should I do. My medical bills are racking up.

Unless the policeman SAW the accident, the report is not binding. There are duties both ways. Pedestrians need to keep a proper lookout, as do drivers. Were there witnesses? IF so, it is crucial to get their information as they can shed some light as to what happened. Due to the gravity of the situation, you should get a lawyer IMMEDIATELY. Many times police reporte are wrong..we had a recent case of a van with 8 blacks being hit by a pickup driven by a young 22 white man..police held van at fault..our investigation showed pickup at fault..and you need a lawyer to investigate your case...

Since parking lots are privately owned, the police officer may not have devoted much time to your report. Sometimes they refuse to even do reports for parking lot accidents. I agree with you that a pedestrian must be given the right-of-way in parking lots, but the standard that will be applied to both you and the driver is whether you used ordinary care, for example, were you watching where you were going, was the driver paying attention.

It is important that you seek the services of an attorney that practices personal injury. This should be done while the facts are fresh. Hopefully, the attorney will be able to establish that you were not at fault and that the truck driver is solely responsible for what happened.

While it would have been helpful for the police officer to put fault on the truck driver, it is not uncommon for police reports to be wrong--he may not have done a complete investigation.
