Legal Question in Personal Injury in Texas

Hit and run by uninsured, caught by police

While parked in front of my home my car was hit by a drunk driver who fled the scene. The police saw the collision and pursued. The driver was arrested and cited for hit and run, and dwi. However, the driver has no insurance and I do not have uninsured coverage. I am trying to determine what my options are, if a lawyer is neccessary, and whether or not I should try to settle with the driver myself, without a lawyers assistance. Thanks for your time.

Based upon the facts in your scenario, you are talking about recovering money from a person so irresponsible that he does not carry insurance. That is what uninsured coverage if for. Based upon your inquiry, I don't see how you are going to recover money from this person unless he was driving on a mission for an employer or something like that. It seems to me your only possibility is to file a suit and seek a judgment which may or may not be paid. Expenses in such a case could be as little as $500 - maybe more. You might see if a lawyer would help you on this, but it is not a case that I would accept. Sorry.
