don't trust my attorney

My daugher and I was in a car accident in Oct'03. We were hit in the back while at a complete stop at a red light. We have several witnesses. The person who hit me big insurance company total my car. My daughter and I went to the hospital and had PT done. My medical bills total approx $5500 and my daughter $1100. I lost wages of approx $500 from my full time job and quit my part-time job which I had for 2 years due to no car. Also, I was out of pocket for the rental car they furnished approx $150.00. They offered to settle on my case for $2900 and my daughter $850 in Feb'04. Now the offer is $5800 and $900. Neither offer covers the medical bills, lost wages..etc. My attorney claimed that he sent demand letter of $25000.00. Now he wants me to settle for the above amounts. I told him no and he said I was being unrealistic thinking I'm going to get more. Again I was hit in the rear hard enough to ''bend the frame'' of my '98 Mazda 626. I instructed him to file suit against them. My attorney seems hesitant. He will not return my calls, I have requested to have a meeting. I've emailed. What am I to do. It's to late in the game to get a new attorney. How much approx is this case worth? Can I request copies of all documents?

I recommend that you make an appointment with your attorney and have a meeting with him. Discuss your case and ask about your options including filing suit.

Currently in most of Texas there is an anti-Plaintiff fervor fueled by the tort reformers who believe that every lawsuit is frivolous regardless of its merit. Those citizens make up the jury pools, and have been awarding low verdicts regardless of the pain and suffering endured by the plaintiff. Sometimes, the juries don't even award the amount of the medical bills. The insurance companies know this and use it to their advantage by giving "low-ball" offers to Plaintiffs to settle their cases. Talk to your lawyer, he represents you and your interests.
