Legal Question in Real Estate Law in Texas

We own 4 acres, where our 100 year old home is located on part of that 4 acres, in Rusk County, Texas. Our neighbor owns 2.something acres on the east side of us. She is putting up a large wooden structure on what we believe to be, in part, on our property which is behind her house in a wooded area. She did not obtain a new survey before she started building nor inform us of her intention to build this wooden structure before she started. My question is whose responsibility is it to obtain a new survey on this part of the property....her's because she is building this structure and is not sure of the property ownership, or us, who do not want this structure on the property, if it is our property? without a lawsuit..or friendly agreement on costs...no one is obligated to pay...but if a lawsuit is filed ask the lawyer if i twill cover the cost of survey..
