Legal Question in Wills and Trusts in Texas

changing an administrator on a will

My daughter passed in 2005. She willed everything to me. She was divorced for over 5 years. Me, her mother, was administrator on that will. Her ex=husband went to a judge and had her mother taken off as administrator and himself put on the will as the administrator. Also moved into her home and put everything in his name. Is this legal??? What would be the consequences for him if this is not legal? He is contesting the will but I feel it is not right to do all of the above before the estate has gone to court to be settled.

Re: changing an administrator on a will

You should have been served back whenever the ex-husband applied to be administrator, and that was the time for you to respond and get involved. You need legal representation in Texas to try to undo what was done. Hopefully it is not too late. You should have retained counsel as soon as you found out what was going on. If you just found out, then you may have a better chance of getting what he's done set aside. Do not delay another minute.
