Legal Question in Wills and Trusts in Texas

I live with my boyfriend. At the present time we do not plan on getting married for a few years yet. My question is: we have both agreed that we would like to be able to make decisions for the other and/or be able to visit the other if either should ever be in the hospital or have a serious injury. We would like something in writing because neither of our families like the person we are with but this is the way that WE want it to be.Can you please tell us what to do?? We have been living together for almost a year and I realize that in this state we are considered married but will that be enough?? Thank you so much for your answer.

Since you and your boyfriend don't plan on marrying for a few years, your cohabitation doesn't constitute a common-law marriage.

What you both want are documents called Durable Power of Attorney For Healthcare. Each of you would sign those documents. That will give the other authority to make health care decisions when the granter of that authority is unable to do so. It has nothing to do with marriage.
