Legal Question in Wills and Trusts in Texas

Does an heir have the right to see a copy of the will?

My Father passed away years ago. My Mother passed away recently. I have 2 brothers and one sister all living. My older sister was named to be executrix of Mom's will. After 5 months, little has been accomplished in settling the estate. 1. Does an heir have a right to see the original will? -or- a copy of the will? be given a copy of the will? 2. My house was left in trust by Mom, do I have the right to have a copy of the trust see a copy of the trust? 3. Does the executrix/trustee have the right to withhold the said will and trust from me ie.. not explicitly stated in the will?

1. You don't have a right as a matter of law, but you can get an attorney to help you press the issue.

2. You don't have a right as a matter of law, but you can get an attorney to help you press the issue.

3. That's a 'maybe' since the executrix doesn't have an obligation to give you copies of anything. However, you can get an attorney to help you press the issue.

If your fatehr's and mother's estates have been filed for probate, all the documents (wills, etc.) that have been entered in those court actions are matters of public record and you can see the files.
