Legal Question in Wills and Trusts in Texas

My Mother and Step-Father had a signed will & trust. Their were stipulations that if one of them were to pass that half of the trust would be placed in an Exemption Equivalent Trust (EET) with the other spouses oldest child acting as co-Trustee of the EET. Now, my Mother has passed and my step-father is trying to change the will & trust. Even scarier is he now says he can't find the signed copy and what he had drafted as the new will & trust does not match my Mother's wishes. What can I do?

File for probate and assets go by Texas Law...ie her half goes to children....per law..but the trust was to save money/avoid probate..and it will cost some money..so hire a lawyer in your county
