Legal Question in Wills and Trusts in Texas

probate

My father passed away five years ago leaving no will. I have 3 other siblings, but my older brother is trying to take all. He's even put my dad's house for sale without contacting the others. He feels he's entilted to more because he's older. Will the estate and the profits of the sale be split evenly or does he have a right to do as he pleases?. What should i do in this situation? We are scheduled for probate court soon, so how should i prpare myself

Re: probate

The estate should be evenly split among the four of you. You'd best hire a lawyer to protect your interests, since the court will name a dependent administrator if the four of you can't agree on an independent administrator.

Your older brother has no authority to sell the house.

If the probate is in Harris or Montgomery County, and you'd like to see whether you'd like our firm to represent you, please send email to me.

Unless you have training and experience in these matters, you better get a lawyer. There is no short course available for free on the internet.

Be sure and go to the hearing to make sure the truth is told. If you are very concerned about shenanigans, contact an attorney to protect your interests.
