Legal Question in Wills and Trusts in Texas

Where do I stand?

My dad passed away in 1989. My brother backed up with my dad's pickup and hauled off everything that he wanted including the pickup, with no ones OK. He also had the business that my mother and dad had set up and he kept all of that, including getting my mother in trouble with the IRS over the business. Now we are having to get a guardianship for my mother in order get rid of a man friend that refuses to leave her alone (he has taken her money, gives her very unsound advice and brainwashes her into doing as he says). Mother has told me that she will sign over the house to me and the house needs a lot of repair and is a very inexpensive house. I have contacted by brother through the mail service to see if he will also sign over the house to me (There are also a substantial amount of taxes due on the house) and I have not received an answer to my inquiry. If we proceed with the guardianship, can the house still be sold. I am the one that is applying for the guardianship. My mother is very forgetful and changes her mind from day to day. She is living in an assisted living facility and just loves it. What legal rights do I have in this matter?
