Legal Question in Wills and Trusts in Texas

i was wondering if you could answer a question for me?

a person that is told something to thier face, in person, directly from the source of the subject in question, about specific information that is pertinent and would influence the outcome of the law suit, is that person a witness or is that person's testimony discounted as "hear say"?

please take a minute and let me know your opinion, i would greatly appreciate your view point.

if you need me to explain further, no problem, i was just trying to make it short and sweet.

thanks,

eddie.
