Legal Question in Real Estate Law in United Kingdom

Names on house deeds.

My partner and I are buying a house together. He has his share i I need a mortgage. Because he is not on my mortgage we have been told that he cannot go on the deeds. He has been advised not to go onto the mortgage as he is over 60yrs.How do we stand as our will states that the sole survivor gets any property that has been bought jointly. I was told a while ago that you can put whoever you want on the deeds. Thank you

Re: Names on house deeds.

All mainstream mortgage lenders will insist that the borrower is the sole owner because otherwise they would have difficulty enforcing their mortgage. You will need to ask your solicitor to draw up a trust deed setting out how you want to hold shares in the proceeds of sale of the property
