bank accounts upon death

i would like to know if there is a legal basis (code or case law) for freezing a bank account upon a persons death, and not allowing his hiers to take action in the account,in the time between the death and the probate (i hope im using the right turm).

There is not any legal obligation upon a bank to release funds held in the account of a deceased person until such time as a grant of probate has been made to an executor thereby providing them with a legal entitlement to the monies.
