flooded out

We have lived in Bear River City Ut for 21 years. We have a pasture all around our home. On the west side of our property is a main drain ditch for the entire city block, but they now have built a home there and they did not put in a culvert or any kind of drainage so there would be place for the water to drain. When they started to built this home My husband went to the Home Owner & then the city office & asked if they knew that was the main drain ditch,and said that they needed to put in a culvert or drainage system in so we wouldn't get flooded out. This was in the summer of 2008. They filled in the ditch with no drain system in there. We contacted them several times and the Mayor and Home owner kept blaming each other for the responsibility of the drainage system. And now that the snow is melting our barn has been flooded out we lost over 12 ton of 2nd crop premium alfalfa hay at 265.00 a ton. We are still fighting the water problem and getting no help from either of them. We feel that we are the ones caught in the middle and are losing our property in the mean time. Who is responsible for our hay that has been lost in this flood. The City or Home owner

I recommend that you sue both the City and the property owner. Let the court work out which one is primarily responsible. You will get paid and they can work the rest out between them. You may call for a free consultation.
