Legal Question in Constitutional Law in Utah

auto dealer changes dates for payments and interest

We purchased a car on a '0' down '0 payment '0' interest for 12 months. First payment was to be 3/3/2002 and interest was to acurr beginning 2/3/2002. Our first bill arrived with a due date of 2/1/2002 and later we discovered that the interest started 1/1/2002. The finacial institute sent us a copy of the contract and the dates we had signed had been crossed out and changed. We were not notified of the change or asked to sign a new contract. What are our rights? Is this an invalid contract?

Re: auto dealer changes dates for payments and interest

If your copy of the contract has different dates, then it will be upheld in court - if the case gets that far. The dealer sold the note to the finance agency. Talk to them and show them the original contract. They will have some power over the dealer and may be able to help you resolve this. The fact that the dealer made changes without your approval makes those changes invalid, although the underlying contract is still valid. You should be entitled to a credit for the months interest was charged before the start date.
