company that owes us $ is thinking about bankruptcy

my husband had a contract through his business with a company for 73000/yr. (they could fire and he could quit at will) He worked 1 mo. only because the first check bounced (they said they would reissue and pay all fees) and the 2nd never came. (His business is just him and this job was our main source of income at that time, we were very lucky that another job was offered from a different company because they the former had not paid us) they do not dispute owing him the money-yet, but now the company is considering bankruptcy. They have paid 0 and they owe 6083.33+2 bank fee for the bounced check. Is it something we will be able to collect on if we take them to small claims or are we out of luck even if we win because of the possible bankruptcy? what should we do?

You can try to get a judgment, then you can execute against any of their assets. If they file BR you can file a claim, unpaide wages get priority over many other claims.
