Legal Question in Family Law in Utah

agreed to unreasonable property settlement

My fiance agreed to pay $300,000 dollars in cash as a partial property settlement in his divorce. He said he would have agreed to anything in hopes of winning her back. There average annual income was probably $20,000 to $30,000 a year. She has a jugdement against him secured by some land. Is there any way to get a judge to see the real numbers? Will a bankruptcy judge look to see why this unrealistic number was ever established in the first place? Any options or hope? The interest alone she was awarded in the judgement is more than twice his gross monthly income. Can justice be served?

Re: agreed to unreasonable property settlement

This is a serious problem and a detailed interview would be required with the attorney having a copy of the divorce decree. There is a reasonable chance that with the proper presentation, subject to all of the facts, that a change could be made. A petition to modify the decree is necessary. He may call for a free consultation.
