Child Custody

My ex boyfriend and I have 3 children. He is unemployed, on parole, and has a history of drug use (can be verified by hospital records). I am engaged, stay home mom and fiance is an electrician and works 40 hrs a week. My ex is not paying any child support nor sees the children on a regular basis because of his lack of ambition to. Can I go after him for his parental rights?

Re: Child Custody

If the father has had no contact with the children for more than 6 months, you can ask for a court order finding that he abandoned the children, and give you sole legal and physical custody. His obligation to pay child support will continue.

From that your new husband, if he so chooses, can ask the court to allow him to do a "step parent" adoption.
