Legal Question in Family Law in Utah

child custody for military father

My son (7 yrs old) lives in OK w/ his mother. We've been on good terms for the most part. Last summer I asked her opinion and expressed my concern to her about him coming to stay with me for a year b/c of school/discipline issues. She freaked & sent me papers for custody & a restraining order to keep him from me until settled. I can prove it was uncalled for. Within a month she apologized & said we could work it out out of court & get a custody decree drawn up with Joint Custody. She still hasn't sent the paperwork stating it's all dropped but keeps saying it's on the way. My son will be here for his summer visitation (thank goodness because I didn't get my Christmas visitation because the restraining order papers to drop hadn't gone through yet) the papers still haven't come but she is sending him anyway & I've expressed written consent to say he can be here from her. She is also the one putting him on the plane (I paid for it) I just found out she is pregnant with her 3rd child by a 3rd man, & this is this man's 3 child with a 3rd woman also. She has been taking my son to KS to see her boyfriend (soon to baby's mother)& the custody/restraining order papers say he's not allowed to leave state at all. Would custody be possible?

Without knowing more details I cannot give a specific answer. Custody changes involve a lot of specific criteria, and each one must be evaluated separately. However, you may call for a free consultation.
