Legal Question in Family Law in Utah

Debt after Divorce and Bankruptcy

As part of my divorce I'm responsible for half the medical expenses of my boys. Because she has custody all the medical bills show in her name. A month ago my ex-wife filed for bankruptcy and included all the medical expenses got included in her filing. This included the portion that I was responsible for. She now is asking for me to pay the portion that I responsible for to her to help cover her legal fees. Does she have a legal grounds for this request?

Re: Debt after Divorce and Bankruptcy

No. Your obligation is to pay half of the fees she incurred. With the bankruptcy she no longer is obligated to pay the medical fees, so you do not have to pay her. If you did that becomes an unfair windfall for her. In the future have her send you a copy of each medical bill and insurance payment. Then you pay the doctor one half of the bill, rather than paying her directly. If she has to pay an office visit cost up front, pay half of the amount on her receipt.
