Utah Non-Compete Law

A friend of mine recently left a

company that she felt was taking

advantage of her and all that she

brought to the company I.e.

Intellectual property designed by her..

Needless to say she left the company

and started her own personal fitness

and nutrition business. Amidst this her

previous employer where she was a

commisioned employee is threatening

to sue her for starting a similar

business albeit one where she didnt

proactively pursue her previous clients

or use copyrighted materials from said

company. Does this company have a

case?

Absent an enforceable non-compete agreement, probably not, especially if no trade secrets are involved nor improper conduct. This can be a complex area of the the law but simply going into a competing business is not in itself something that can be prohibited.
