Legal Question in Real Estate Law in Utah

future property boundary disputes

I want to build a garage. I live in an old neighborhood where boundaries are unsure, but agreed upon. I would build to zoneing codes, going by agreed upon boundaries with current neighbors. If owners change in adjacent properties, and the new owners want to dispute what was used as property lines, what recourse would I have? I have not had property surveyed, as I am told surveys of these old neighborhoods are notoriously innacurate.

Re: future property boundary disputes

It would be wise for you to have a written and notarized agreement with your neighbors declaring what the property line is, and include legal descriptions of your respective properties, then have the agreement recorded. Any subsequent buyer of your or the neighbor's property would be on official notice, and would not prevail in a lawsuit. Note, that property lines more than 20 years old which are "Agreed" upon are usually enforced by the courts.
