The short answer is that no one is required by law to join the MLS.

The MLS, Multiple Listing System, is a service exclusively for "Realtors," which is a trademarked name for real estate agents and brokers belonging to the National Association of Realtors, an industry trade association.

The real estate licensing system licenses real estate agents and brokers, which is completely separate and independent of any trade association.

One can be a licensed agent or broker without being a "realtor."

The major limitation of those holding real estate licenses (real estate sales agents) is that in order to legally participate in a real estate transaction as an agent, one must be formally affiliated with a licensed real estate broker.
